European Commission (EC) Published Guidance on the Application of Non-price Criteria under the Net-Zero Industry Act (NZIA)

/BRUSSELS, July 24, 2026, 11:00 CEST, RENEWABLE MARKET WATCH™/ The European Commission has released two comprehensive guidance documents detailing the implementation of Article 25 and Article 26 of the Net-Zero Industry Act. These documents are designed to strategically harness public procurement as a catalyst for strengthening Europe’s manufacturing ecosystem for net-zero technologies.

By emphasising not only price competitiveness but also sustainability and supply chain resilience, the guidance aims to ensure that public investments actively incentivise projects and products that contribute to the long-term security and sustainability of the EU’s clean energy infrastructure.

Article 25 mandates that contracting authorities integrate minimum environmental sustainability standards and resilience criteria into public procurement for net-zero technologies. This approach is intended to diversify and secure the EU’s cleantech supply chains, reducing overreliance on single sources and enhancing the robustness of Europe’s industrial base. Article 26 requires EU Member States to incorporate non-price criteria into renewable energy auctions, both at the pre-qualification and award stages. These criteria encompass factors such as responsible business practices, cybersecurity and data protection, demonstrated project delivery capability, and the measurable impact of projects on sustainability and supply chain resilience.

The guidance documents provide practical instructions for contracting authorities, EU institutions, and market participants on the operationalisation of these requirements, facilitating effective and consistent implementation. Developed in response to queries from national authorities and stakeholders following the entry into force of these obligations on 30 December 2025, the guidance aims to ensure harmonised and proportionate application of the new standards across all EU Member States.

The Net-Zero Industry Act, effective since June 2024, seeks to rapidly expand the EU’s domestic manufacturing capacity for net-zero technologies essential to achieving the region’s climate and energy objectives. By embedding non-price criteria into public procurement and renewable energy auctions, the Act leverages public sector demand to drive industrial growth, reduce strategic dependencies on external suppliers, and reinforce the resilience of Europe’s clean energy value chains.
